Supreme Court Directs Centre to Develop Model Policy on Menstrual Leave for Women Employees

The Supreme Court of India has directed the Centre to develop a model policy on menstrual leave for women employees. The court disposed of a Public Interest Litigation (PIL) seeking menstrual leave and emphasized the need for consultations with state governments and other stakeholders. The policy aims to enhance women's participation in the workforce by addressing the need for menstrual leave. However, the court also flagged potential downsides, such as the risk of women being shunned in the workplace. The bench, comprising Chief Justice D.Y. Chandrachud, Justice J.B. Pardiwala, and Justice Manoj Misra, highlighted that the policy should consider both college students and employees, suggesting two or three days of menstrual leave per month. The court noted that menstrual leaves may encourage women to participate more in the workforce.
