Smith's final report, released after his resignation, detailed why he did not charge Trump with incitement of insurrection under 18 USC 2383, citing insufficient evidence to prove that the January 6 Capitol riot constituted an insurrection or that Trump incited it. Despite this, Smith expressed confidence that Trump could have been convicted on other charges had he not won the election. The report also dismissed claims of political interference in the prosecution as 'laughable.'
