President-elect Donald Trump has filed a motion requesting that New York Judge Juan M. Merchan delay his sentencing in the hush money case scheduled for Friday, January 10. Trump's legal team is appealing the ruling that upheld his May conviction on 34 felony counts of falsifying business records related to hush money payments to porn star Stormy Daniels. They argue that the sentencing should be halted while the appeal is considered, citing presidential immunity following his election victory. The defense plans to take the appeal to the Appellate Division, First Department. Judge Merchan had previously ruled that the sentencing could proceed despite Trump's imminent inauguration on January 20, assuring no jail time. If the sentencing proceeds, Trump would become the first president to take office convicted of felony crimes.
