A judge has dismissed a lawsuit challenging Arizona's Proposition 140, which seeks to establish a system of nonpartisan primaries. The lawsuit, brought by the Arizona Free Enterprise Club, claimed there were not enough valid signatures on the petitions. However, Judge Moskowitz ruled that it was too late to remove the measure from the ballot as ballots are already being sent out. He also found the method used to determine the validity of signatures unconstitutional, making the challenge moot due to the Aug 23 ballot printing deadline. The Arizona Free Enterprise Club has vowed to appeal to the Supreme Court.
