The court rejected RWE Renewables' challenge to a summer 2021 PUCTX order that directed the wholesale electricity price to the cap anytime load-shedding occurs. Additionally, the court disagreed with Luminant's argument that the PUCTX exceeded its authority by ordering the electricity price to the $9,000 per megawatt-hour cap during the blackouts. These rulings affirm the authority of the PUCTX over utilities in setting electricity prices during emergencies, which cost Texans billions during Winter Storm Uri.
