The Texas Supreme Court has issued rulings in two significant cases related to the 2021 blackouts, siding with the Public Utility Commission of Texas (PUCTX). The court rejected RWE Renewables' challenge to a summer 2021 PUCTX order that directed the wholesale electricity price to the cap anytime load-shedding occurs. Additionally, the court disagreed with Luminant's argument that the PUCTX exceeded its authority by ordering the electricity price to the $9,000 per megawatt-hour cap during the blackouts. These rulings affirm the authority of the PUCTX over utilities in setting electricity prices during emergencies, which cost Texans billions during Winter Storm Uri.
