Jury Deadlocked on Daniel Penny's Manslaughter Charge in Jordan Neely Subway Chokehold Death

On December 6, after four days of deliberations, the jury in the trial of Daniel Penny informed the court that they are deadlocked on the charge of second-degree manslaughter. Penny, a 26-year-old former Marine, is accused of recklessly causing the death of Jordan Neely, a homeless Black man, by placing him in a six-minute chokehold on a New York City subway in May 2023. The jurors sent a note to Judge Wiley stating, 'At this time, we are unable to come to a unanimous vote on Count 1 – manslaughter in the second degree.' The judge has given the panel an Allen charge, urging them to continue deliberations in an effort to reach a unanimous verdict.
