Apple Seeks Dismissal of DOJ, 15-State Antitrust Lawsuit
May 21, 2024, 06:00 PM
Apple is seeking to dismiss a lawsuit filed by the U.S. Department of Justice (DOJ) and 15 states, which alleges that the company monopolized the smartphone market, hurt smaller rivals, and drove up prices. The lawsuit, filed in March, accuses Apple of using its market power to extract more money from consumers, developers, and others. Apple argues that the DOJ's case relies on a new theory of antitrust liability that no court has recognized. Apple plans to ask US District Judge Julien X. Neals for the dismissal. The company is also defending itself in a separate antitrust case brought by Epic Games, where U.S. District Judge Yvonne Gonzalez Rogers has expressed skepticism over Apple's compliance with previous court orders from 2021.
