The judgment includes a $489 million penalty, which has grown by $24 million in interest. The five-judge panel expressed skepticism about the state's case, questioning whether the $454 million penalty was too high and if the New York Attorney General, Letitia James, overstepped her authority. One judge, Peter H. Moulton, called the penalty 'troubling.' The decision could come before Election Day, and Trump has one more appeal available if this effort fails.
