Republican Representative Nancy Mace of South Carolina announced on Monday that she is introducing a resolution to ban transgender women from using women's restrooms at the U.S. Capitol. This measure would directly affect Rep.-elect Sarah McBride, a Democrat from Delaware and the first openly transgender person elected to Congress, who is set to take office in January. Mace stated, "She was born a biological male, she should use the men's restroom. That's how it should work." The resolution aims to protect "biological women" in private spaces, with enforcement falling under the jurisdiction of the House Sergeant at Arms. The proposal has drawn criticism from Democrats and LGBTQ+ advocates, including Rep. Alexandria Ocasio-Cortez, who called it "just plain bullying." Rep. Marjorie Taylor Greene expressed support for the measure but argued it should extend to all federal buildings. McBride responded by calling the resolution a "blatant attempt from far right-wing extremists to incite hate." House Speaker Mike Johnson indicated that the issue would be discussed further. The resolution must be reintroduced in 2025 to take effect.
