VisitKroger Sues FTC to Block Review of $25 Billion Albertsons Merger

Kroger has filed a lawsuit against the U.S. Federal Trade Commission (FTC) to prevent the review of its proposed $25 billion merger with Albertsons in the FTC's in-house tribunal. Kroger argues that the FTC's in-house judges are unconstitutional and has filed a motion for a preliminary injunction in the U.S. District Court, Southern District of Ohio. The FTC had sought to split the merger challenge into two tribunals and filed a motion in federal court proceedings to block the merger with Albertsons for the duration of the administrative proceeding.
