U.S. District Judge Mark Scarsi in California has dismissed the criminal tax case against Hunter Biden but issued a sharp rebuke of President Joe Biden's pardon of his son. In a five-page ruling, Judge Scarsi criticized the President's statement announcing the full and unconditional pardon, stating that it attempted to 'rewrite history' and misrepresented the facts of the case. He emphasized, 'In short, a press release is not a pardon.' The judge noted that 'nowhere does the Constitution give the President the authority to rewrite history,' and highlighted that two federal judges and the President's own Department of Justice had expressly rejected arguments that Hunter Biden was prosecuted due to his familial relation. Judge Scarsi also took issue with the President's assertion that Hunter's tax evasion was the result of addiction, pointing out that this claim was inconsistent with Hunter's own court admissions. The judge underscored that the prosecution and investigation were overseen by President Biden's own administration and criticized the pardon’s broad and future timeframe.
