VisitItaly Fines OpenAI €15 Million for GDPR Violations in ChatGPT Data Use, Orders Six-Month Awareness Campaign

Italy's data protection authority, the Garante, has imposed a €15 million fine on OpenAI following an investigation initiated in March 2023 for breaches related to the use of personal data in training its ChatGPT chatbot. The authority concluded that OpenAI processed users' personal data without an adequate legal basis and violated transparency obligations, contravening the GDPR. Additionally, OpenAI failed to implement age verification mechanisms, risking the exposure of minors to inappropriate content. In response, OpenAI has been ordered to conduct a six-month public awareness campaign across Italian media to educate users on how their data is used for AI training and their rights under the GDPR.
