VisitArizona Supreme Court Grants 90-Day Stay on 1864 Abortion Ban Enforcement Until Sept. 26
May 14, 2024, 01:32 AM
The Arizona Supreme Court has granted a 90-day stay on the enforcement of the state's 1864 near-total abortion ban. This decision allows Democratic Attorney General Kris Mayes time to potentially appeal the reinstatement of the ban to the U.S. Supreme Court. The stay will prevent the ban from becoming enforceable until at least September 26, preserving abortion access in Arizona through the summer. The ban's enforcement is paused through Aug. 12. This move follows a recent legislative vote to repeal the Civil War-era law, which criminalizes nearly all abortions. Abortion access is preserved up to 15 weeks of pregnancy, Mayes confirms.
