Daniel Penny Jury Deadlocked on Manslaughter Charge in Death of Jordan Neely

On December 6, 2024, after four days of deliberations, the jury in the trial of Daniel Penny, a former Marine accused of manslaughter and criminally negligent homicide in the subway chokehold death of Jordan Neely, informed the judge that they are unable to reach a unanimous verdict on the top charge of second-degree manslaughter. The 12-person panel sent a note Friday morning stating they were deadlocked on whether Penny 'recklessly' caused Neely's death by placing him in a six-minute chokehold in May 2023. During the deliberations, jurors requested to rewatch the subway chokehold video, review police and bystander footage, and revisit the medical examiner's testimony. The judge has given the jury an Allen charge, urging them to continue deliberations to try to reach a unanimous decision.
