On the fourth day of deliberations, the jury in the trial of Daniel Penny, a former Marine charged with manslaughter and criminally negligent homicide in the 2023 subway chokehold death of Jordan Neely in New York City, informed the judge that they are unable to reach a unanimous decision on the top charge of second-degree manslaughter. The judge is expected to deliver an Allen charge to encourage the jury to continue deliberations. The jury had previously requested to review key testimony and rewatch videos of the fatal encounter. If the jury remains deadlocked, a mistrial may be declared.
