Oath Keeper Joshua James Sentenced to Probation, Home Detention for January 6 Role

Joshua James, a former leader of the far-right Oath Keepers militia, was sentenced to three years of probation, including home detention and time in a treatment center, for his role in the January 6, 2021, Capitol riot. James, who previously served as security for Trump ally Roger Stone, was the first Oath Keeper to plead guilty to seditious conspiracy and cooperated extensively with federal prosecutors, providing key information that helped convict other members, including the group’s leader, Stewart Rhodes. His plea deal significantly reduced his potential prison time, as the seditious conspiracy charge carries a maximum penalty of 20 years. James admitted to participating in plans to obstruct the certification of Joe Biden’s presidential victory, including discussions of using lethal force and stockpiling weapons. During the Capitol riot, he assaulted police officers and entered the building with other Oath Keepers. James, a Purple Heart recipient whose medal was later stripped, faced personal risks, including threats against him and his family, for cooperating with authorities. Judge Amit Mehta, who presided over the case, acknowledged James’ military service and PTSD but emphasized the seriousness of his actions in undermining democracy.
