The legislation seeks to make states ineligible to receive Medicaid funding if they have enacted an outright ban on IVF access. This move comes in response to a recent Alabama Supreme Court ruling that determined frozen embryos are legally people, making those who destroy them liable. The senators have emphasized the importance of IVF in helping parents across America start and grow their families. Cruz stated, 'We now have a chance to make it unequivocally clear, to put into federal law, that you have a federal right to access IVF technology if you want to be a parent.'
