Google Seeks Non-Jury Trial in Virginia DOJ Antitrust Case Set for September

Google is facing multiple antitrust lawsuits in various courts, including the Southern District of New York, Eastern District of Texas, and Eastern District of Virginia. The lawsuits allege that Google abused its market power and engaged in auction rigging. In a recent development, Google filed a motion in a Virginia court to dismiss the DOJ's damages claim and strike the jury trial demand, citing actions taken by DOJ lawyers on Christmas 2022. Google is seeking a non-jury trial, arguing that a jury trial is not appropriate under the Seventh Amendment. The U.S. DOJ's adtech antitrust trial, which aims to break up Google's adtech business, is scheduled to begin in September. Google has also tendered a cashier's check for the maximum amount of damages claimed by the DOJ, trebled, plus interest, while denying any wrongdoing.
