High Court Upholds CAK Ruling Against Carrefour for Abusing Buyer Power, Orders Sh289,482 Payment

The High Court has upheld the Competition Tribunal's and the Competition Authority of Kenya's (CAK) decision that found Carrefour Supermarket guilty of abusing its superior bargaining power. The court ordered Carrefour to amend its supplier contracts and pay Orchards Ltd Sh289,482 in rebates. This ruling follows the CAK's initial findings in February 2020, which concluded that Carrefour had exploited its dominant position in the market.
